Whether you may work for yourself in Germany depends on your nationality, residence rights and the specific conditions attached to your status. You do not always need a new permit under section 21 of the Residence Act (AufenthG). Before accepting your first assignment, check both sides of your residence card, its supplementary sheet (Zusatzblatt) and any provisional residence document (Fiktionsbescheinigung).
Three expressions you need to distinguish
In German residence law, Erwerbstätigkeit includes both employment and self-employment. Beschäftigung means work as an employee. Practising a liberal profession (freiberufliche Tätigkeit) is also self-employment. These terms are not interchangeable; see section 2(2) and section 4a AufenthG.
- “Erwerbstätigkeit erlaubt” or “gestattet”: Generally covers employment and self-employment unless additional restrictions apply.
- “Selbständige Tätigkeit erlaubt” or “gestattet”: You may work for yourself within the expressly permitted scope. A restriction to a particular activity remains binding.
- “Beschäftigung erlaubt”: This wording alone does not authorise self-employment. The same applies to permission naming a particular employer.
If your documents say “Selbständige Tätigkeit nicht erlaubt”, contain conflicting entries or impose an unclear restriction, clarify your entitlement with the immigration authority (Ausländerbehörde) before starting. Business registration or a tax number does not expand your residence permission.
EU, EEA and Switzerland: special rules
EU citizens can generally establish themselves as self-employed persons under freedom of movement. This also applies to Iceland, Liechtenstein and Norway. No separate work permit or “Freizügigkeitsbescheinigung” is required as permission to start; see section 2 FreizügG/EU and section 12 FreizügG/EU.
Registering your address with the residents’ registration office is a separate matter. Business registration, tax registration and professional authorisation may still be required. Swiss citizens are covered by the freedom-of-movement agreement and specific residence formalities; where applicable, the immigration authority issues an Aufenthaltserlaubnis-CH. Ask about the relevant procedure; Berlin’s official page for Swiss nationals explains this residence right.
Which German residence permits allow self-employment?
Self-employment is generally possible in the following situations. A valid legal status and any lawful restrictions remain decisive:
- Niederlassungserlaubnis: A German permanent settlement permit generally allows self-employment; section 9 AufenthG.
- German Erlaubnis zum Daueraufenthalt – EU: A German EU long-term residence permit is generally equivalent to a settlement permit; section 9a AufenthG. A corresponding permit from another EU country does not automatically allow you to settle and work for yourself in Germany.
- Family-reunification residence permit: Generally allows Erwerbstätigkeit, including self-employment. Switching to section 21 is not automatically necessary; see section 27 AufenthG together with section 4a.
- Residence permit under section 25(1) or (2): Recognised asylum beneficiaries, refugees and persons granted subsidiary protection generally have access to Erwerbstätigkeit; section 25 AufenthG. This differs from an Aufenthaltsgestattung during an asylum procedure.
- Residence permit under section 24: Temporary protection generally also permits self-employment. Check the documented permission “Erwerbstätigkeit erlaubt” and validity; section 24 AufenthG. Merely applying is not the same as receiving permission.
Other humanitarian permits and special cases require assessment under their particular legal basis. The word “Aufenthaltserlaubnis” alone does not answer the question.
Section 21: residence for self-employment
If you need residence permission for your business venture, several routes may be relevant:
Commercial business under section 21(1): The assessment considers economic interest or regional demand, expected positive economic effects, and secured financing through equity or a loan commitment. A viable business plan, experience and financial planning matter. The law sets no blanket minimum investment or fixed minimum number of jobs to create.
Liberal profession under section 21(5): Different requirements apply than for a commercial venture. Any required professional licence must have been granted or its issue assured. “Freelancer” is not a tax or residence category you can simply choose for yourself.
Other routes: Subsection 2a provides facilitated access, subject to conditions, for graduates of German universities and certain researchers and scientists where the venture relates to their qualifications. Subsection 2b covers certain skilled workers with a publicly funded start-up grant sufficient to cover living costs, for a maximum stay of 18 months. All these routes are set out in section 21 AufenthG.
General requirements such as a passport, secured living costs and health insurance also matter. People older than 45 should generally demonstrate adequate retirement provision. The possible settlement permit after three years is conditional; this special rule does not apply to liberal-profession permits under subsection 5. Make it in Germany offers a practical overview.
Employment, EU Blue Card and study
A permit for a particular job or an EU Blue Card is not blanket permission to run your own business. Check whether self-employment is expressly permitted in addition. With a residence permit for another purpose, additional permission under section 21(6) may be possible while retaining that purpose. The authority decides your case; switching entirely to self-employment may require a different permit.
For study under section 16b AufenthG, the statutory working-day rules concern employment. They do not automatically allow freelance assignments. Self-employment alongside study needs separate permission; study remains the purpose of residence. Low turnover or a single assignment does not remove the need to check.
Applications, provisional documents, asylum proceedings and tolerated stay
If you apply in time to renew or change a permit, the previous permit may remain valid under section 81(4) AufenthG, including its existing restrictions. This creates no new permission for self-employment. A Fiktionsbescheinigung under subsection 3 has a different effect. Check the legal basis and recorded permission to work, and obtain clarification of unclear entries.
An Aufenthaltsgestattung or Duldung is not a residence permit and does not itself authorise self-employment. Permission to work as an employee under these arrangements is insufficient. Seek individual advice about possible residence routes; section 61 AsylG deals particularly with access to employment during asylum proceedings.
Check your situation in five steps
- Read your documents: Identify your nationality, legal provision, validity dates and all conditions.
- Describe the activity: Commercial business or liberal profession, actual services, main or secondary occupation, time commitment and financing.
- Clarify your entitlement: If restrictions apply, contact the immigration authority and request the necessary permission before your first assignment. For visa proceedings, the German diplomatic mission is generally responsible.
- Prepare evidence: Depending on the procedure, passport, current permit and supplementary sheet, business and financial plan, qualifications, prospective clients, health insurance and any professional licence or retirement provision. The responsible authority supplies the definitive list.
- Complete other start-up duties: Once entitlement is clear, arrange business and tax registration and any chamber or craft-trade registration. Apply for renewals in good time.
Frequently asked questions
Is business registration or a tax number enough?
No. Neither replaces required residence permission. Conversely, registration and tax obligations do not disappear merely because your residence situation is unclear.
Does this also apply to a side business or small invoices?
Yes. Self-employment as a secondary activity must also be permitted. The German VAT exemption scheme for small businesses (Kleinunternehmerregelung) concerns VAT and creates no residence right.
Can I start while my application is being processed?
Only if your existing or expressly confirmed permission covers the proposed activity. An application, appointment booking or acknowledgement of receipt alone is insufficient.
Organise your documents and office work
Keep your permit, supplementary sheet, official decisions and deadlines in order. Motorica.io can then help you manage invoices and quotes. The software does not replace an assessment of residence rights or official permission.
This overview concerns Germany and does not replace an assessment of your individual case. Ask the responsible immigration authority or a qualified residence-law adviser about unclear entries.
